No Doubt Sues Activision For Improper Use Of Their Likeness In ‘Band Hero’

While Taylor Swift may be happy to be a part of the new video game title Band Hero, I have it on pretty good authority that the members of No Doubt are NOT happy with the game. It turns out that No Doubt is pretty pissed that the game title allegedly misused their likeness against their wishes by not even asking how their likeness would be used in the game … as a result, No Doubt is suing Activision, the company that makes the game:


Rock band No Doubt has filed a real-world lawsuit over its virtual role in the just-released Band Hero edition of the Guitar Hero video game series, claiming that the game has “transformed No Doubt band members into a virtual karaoke circus act,” singing dozens of songs the group neither wrote, popularized nor approved for use in the game. In a suit filed today in Los Angeles Superior Court, the band alleges that Santa Monica-based Activision, the maker of the game, has far exceeded the contractually approved use of likenesses, or avatars, of band members Gwen Stefani, Tony Kanal, Tom Dumont and Adrian Young. An Activision spokesman said the company had not seen the complaint yet and therefore had no comment. “The band [members] are bitterly disappointed that their name and likeness was taken and used without their permission,” manager Jim Guerinot said Wednesday. “They agreed to play three No Doubt songs as a band…Activision then went and put them in 62 other songs and broke the band up [and] never even asked.” The suit also charges that the game allows users to manipulate their characters to sing songs popularized by other pop music acts. No Doubt’s contract with Activision allowed the company to use the band’s music and likenesses in no more than three of the band’s own songs, the suit states. The game, which was released Tuesday, puts the group members’ images, collectively and individually, into more than 60 songs, “many of which include lyrics, contained in iconic songs, which are not appropriate for No Doubt and have not been and would not have been chosen by No Doubt for recordings or public performances.” Specifically, the suit notes that through the game’s Character Manipulation Feature, Stefani’s image can be induced to sing the Rolling Stones’ “Honky Tonk Women.” “While No Doubt are avid fans of the Rolling Stones and even have performed in concerts with the Rolling Stones,” the complaint states, “the Character Manipulation Feature results in an unauthorized performance by the Gwen Stefani avatar in a male voice boasting about having sex with prostitutes.” It also states that bassist Kanal’s likeness can be manipulated to sing, in a female voice, one of No Doubt’s signature hits, “Just a Girl.” “Activision has deceived and confused the public into believing that No Doubt authorized the use of its name and likeness for the Character Manipulation Feature of Band Hero and that No Doubt approves and endorses the appearance of its members individually performing songs that are wholly inappropriate and out of character for No Doubt,” according to the complaint. The suit states that Activision executives withheld disclosure of the character manipulation feature, and refused the band’s request to remove or disable it in conjunction with the No Doubt avatars after the band learned how they were being used. The complaint says Activision officials told the band that doing so would be “too expensive.” “Perhaps most disappointing is when Activision was made aware of the problem, rather than make a fix they admit was technically feasible, they made a business decision that both the time and money required to do the right thing were too much,” Guerinot said. “I guess they are developing the next level of the game: corporate Rock Hero.” The suit asks for unspecified actual and punitive damages, a temporary restraining order, a preliminary injunction and a permanent injunction against distribution of the game and for Activision to recall existing copies.

Damn … if the band’s allegations are to be believed it is pretty crappy that the company would just run wild with No Doubt’s likenesses like that. It’s one thing to have the band perform other songs but quite another to break up the band when they are very adamant about staying a single unit. I find it very hard to believe that Activision will be able to recall all the copies that have been sold thus far … my guess is that if they want this lawsuit to go away, they’re gonna hafta pay up. In the meantime, you might want to run out and buy Band Hero while you still can … depending on how this lawsuit turns out, the game might be in high demand … or may disappear altogether.

Shirley Manson Joins No Doubt On Stage In LA

How’s this for an awesome surprise … No Doubt played a concert here in LA last night at the Gibson Amphitheater in Universal City and brought out a very special surprise guest for their encore performance. During their cover of the Adam and the Ants song Stand and Deliver, Shirley Manson of Garbage came out on stage to duet with Gwen and No Doubt on the track! Here are caps from video of the performance along with a short review of the overall No Doubt concert:


No Doubt never get old. Their comeback jaunt could’ve easily been dubbed “The Forever Young Tour.” The Orange County pop rockers sounded better than ever at the sold out Gibson Amphitheater tonight. Gwen Stefani, Tom Dumont, Tony Kanal and Adrian Young were just as magical as they were when Tragic Kingdom took over pop culture back in 1995—maybe even more so. A white curtain covered the stage at the start of the show. Four shadows instantly came into frame. It was more like the beginning of a Stanley Kubrick film than a rock show. Instead of a big black monolith, the crowd got one of the most important musical acts of the 1990s. With as many hits as they have, they’re monolithic in their own right. The white ramp riser curled around the entire stage, and it gave Gwen and Co. a whole lot of room to bounce around … Gwen didn’t speak much, but when she did she was greeted with massive cheers. She smiled, “I can’t believe this is my life! This is incredible.” What makes Gwen great is she’s still “Just a Girl” though. She busted out a few push-ups really quickly and then jumped into her massive girl power anthem, even getting the boys to belt out the chorus. The ultimate girl power moment came during the encore though. Garbage’s Shirley Manson and openers The Sounds joined No Doubt for a rousing rendition of Adam Ant’s “Stand and Deliver.” Gwen and Shirley are icons to a whole generation of females, and seeing them on stage together was a momentous, once-in-a-lifetime occurrence. Their voices volleyed back and forth incredibly, and the audience erupted.

No Doubt Does ‘The Today Show’

No Doubt, who has been on a bit of a hiatus in the past few years, made their triumphant return to the performance stage this morning on The Today Show. The band kicked off the Today Show’s Summer Concert Series by performing a few of their biggest hits — Spiderwebs, Don’t Speak and their Talk Talk cover It’s My Life. Here are a few pics of No Doubt rockin’ out, together again, this morning in NYC:


Today’s performance was the first that the band has done publicly in 5 years! I believe the band will next be seen on the May 11th ep of Gossip Girl where they will portray the fictional 80’s band Snowed Out (say the name outloud to get the joke) … then the band will embark on their much anticipated “reunion” tour this Summer. No Doubt Invades ‘Gossip Girl’

The May 11th episode of Gossip Girl is the big ep where the proposed new spin-off series based on the life of the young Lily van der Woodsen in the 80’s gets featured. In order to help kick off the new show, No Doubt has been enlisted to portray the fictional 80’s band called Snowed Out and will perform on the show via 80’s flashback. Saying Snowed Out out loud sounds like you’re saying No Doubt … which is actually kinda cool (thanks Alex). Yeah, it’s a bit confusing but the plan is to entice the viewer into wanting to see more of this new as yet untitled new show. Here is our first look at No Doubt as Snowed Out in the upcoming Gossip Girl ep titled Valley Girls:


May 11 is bound to be a really big day for our beloved Upper East Siders — not only are they getting a potential spin-off starring Brittany Snow and Krysten Ritter, but No Doubt is gracing the show with their SoCal presence. Well, sort of. Gwen Stefani, Tony Kanal, Adrian Young and Tom Dumont will play a fictional 1980s band called Snowed Out in the flashback-heavy hour. We come across the faux-strummers when a young Lily checks out her very first rock show with sister Carol. If all goes according to plan, the “Gossip Girl” spin-off and characters will be appearing on your TV weekly.

It’s funny how the No Doubt of the 80’s looks a lot like the No Doubt of the late 90’s. Nonetheless, I’m really looking forward to seeing the band on the show. I understand that they will be performing a cover of the Adam Ant song Stand and Deliver, which they recorded and gave away to fans who purchased VIP tickets to their upcoming tour. The May 11th ep of Gossip Girl will feature a whole lot more 80’sness than just No Doubt as a faux band. No Doubt Officially Announce Their ‘09 Tour Dates

Gwen Stefani, Tony Kanal, Adrian Young and Tom Dumont recorded and posted a new video for NoDoubt.com to announce the full list of tour dates for the band’s upcoming concert tour with Paramore. Along with this new video, the site reveals that a Tour Club is now available for fans to sign up for in order to gain access to special pre-sale tickets to many of the announced tour dates. Additionally, Gwen Stefani announces that the band is NOT working on a new album and will NOT be releasing a new album … they’re just going on tour with the songs they’ve already got. Woot! This is great news … the band has been teasing us with news about this tour for weeks now. While I’m bummed that the band is not working on new material/will not be releasing a new album I am very excited that the band is going back on the road as a reunited band once again. I’m pretty sure a new album will come from the band at some point soon … I hope. No Doubt Formally Announce Their 2009 Summer Tour

It’s official! NoDoubt.com has been updated with the official news that the band is hittin’ the road this summer on a new concert tour … and they’re bringing the band Paramore with them. Here is the full text of the press release from the band that was posted on their official site today:


Grammy-winning rock band No Doubt announced plans for their 2009 summer tour today. The band will launch their highly anticipated tour this May, playing outdoor amphitheaters and arenas throughout the summer. Singer Gwen Stefani said, “The whole reason for going on this tour was to have fun, try on all our favorite songs again and to get inspired to make new music. It feels good to be all together again.” No Doubt has selected Paramore as the special guest for the tour. “What a dream tour! We couldn’t be more excited to kick off 2009 by touring with a band like No Doubt,” said Paramore singer Hayley Williams. “Get there early…this is going to a be a great night from the moment the lights go down,” said bassist Tony Kanal. The third act that will open the show will be shared among The Sounds, Janelle Monae and Bedouin Soundclash. Check your local listings for more specific information. “Now that five years have passed, the excitement level for us is extremely high. We are so fresh and ready! I feel like a kid again when rehearsing these songs,” said drummer Adrian Young. The 2009 No Doubt Summer Tour will be produced by Live Nation and will include stops in both the U.S. and Canada. You may recall that No Doubt confirmed the the rumors that they would be hittin’ the road this summer but did not make the official announcement until today. That they chose to bring Paramore on the road with them is a big honor for the young band. A lot of folks, me included, have waited a long time for the band to get back together and get out on the road. As of yet, there is still no word on when a new album from the band might be released but I understand that they have been hard at work on new tunes over the past few months. While I’m sure the band will be debuting new songs on the road, it remains to be seen if their next studio album will be ready for release by the time the band hits the road … whenever that may be. At this point, specific tour dates have yet to be announced. Stay tuned … hopefully we’ll know when the No Doubt tour will get underway so that we can start to make our summer concert plans.

No Doubt Confirm 2009 Tour

About 3 weeks ago, the official No Doubt website was updated with a new band photo and a curious iChat session that plainly alluded to the fact that the band was getting ready to announce a set of tour dates for the coming year. This weekend, NoDoubt.com was updated again with a direct message to fans from the band confirming that the band is planning to tour next year … but, have yet to announce any concrete dates. We’re getting closer tho:


Hey Everyone,

As most of you saw from our little iChat (yes, it was really us), we have decided to go on tour next year while continuing to work on our album. We are working on tour dates now and can’t wait to get out there and play for all of you – it’s been too long! We’ll announce tour dates soon so be sure to check back for updates. Have a safe and happy holiday and we’ll see you on the road in 2009!

This is amazing news. I was pretty confident that the last message we got from the back a few weeks ago meant that the announcement of tour dates was imminent … now we know that to be the case. I am really excited for the band to get back on the road … and I’m *dying* to hear new music. Hopefully when next we hear from the band we’ll have concrete dates to plan for. 2009 is already lookin’ like it’s gonna be a great year for live music!
