Eric Dane’s naked romp with wife Rebecca Gayheart and third wheel Kari Ann Peniche may have been a “private, consensual moment” according to his attorney. But according to the police, it could also have been a hotbed of illegal activity. The Los Angeles Police Department confirmed Thursday to E! News that its Detective Support and Vice division is taking a closer look at the DVD that mysteriously made its way into their possession this week, with an unnamed source saying the video may feature some malfeasance on the celebrities’ part. While the tape features the trio lolling around in bed and sharing a soak in the tub, no one actually has sex (which wasn’t illegal last time we checked, anyway). But Gayheart at one point says that she should lie down because she’s “so high,” per Gawker, which posted an edited version of the breastfest. No details were given about what authorities might be looking for, but LAPD spokesman Det. Via Nueva tells E! that they are in the process of examining the “voluminous contents” of the DVD. Well, yeah, they’re nice, but we wouldn’t call them voluminous…

Yipes! See, it’s one thing to appear in a “naked tape” (as Dane’s lawyer likes to clarify since no actual sex acts are featured in the vid) but it’s quite another to brag about the state of one’s alleged drug intake on video … especially a video that has been made available to the world on the Internets and has been made available in “voluminous” footage on DVD to the police. But, to be honest, as scary as the prospect of prosecution may be, I find it highly unlikely that any criminal charges will come from this video. While the vid that we saw earlier this week was edited down and did not show everything, I really doubt the police will find anything that would result in criminal prosecution. Meh, you never know … mebbe there might be a cache of illegal substances featured in the DVD that police now have in their possession but methinks we would’ve heard about that by now. Again, as if any of y’all really needed a reminder, DON’T TAKE PHOTOS/VIDEO OF YOURSELVES NEKKID … and deffo don’t record any illegal drug activity. Duhvs.

If there is one thing in life that we hold as a certainty, it’s this: pretty much everyone who’s ever owned a digital camera (or webcam) has, at one point or another, taken naked pictures or video of themselves. The latest edition in our cavalcade of celebrity sex tapes: Eric Dane, Rebecca Gayheart, and Kari Ann Peniche (known for “Grey’s Anatomy,” Noxema commercials, and beauty pageants/sex work respectively) all got together one day, did some drugs, and got naked. And taped themselves. Is it shocking? Not really: in fact, it’s rather tame (perhaps even more boring than “Kim Kardashian, Superstar”!). Will we ever get to a point where we can just admit that this is normal? That it’s not shocking to learn that a celebrity made a sex tape…because we’ve all made a sex tape? Probably not: but we’ll keep hope alive. When we’re not busy trying to find deep meaning in furiously masturbating to Eric, Rebecca, and Kari’s drugged up naked ramblings.

According to Dane’s lawyer, who is threatening to sue … someone … the video footage doesn’t really constitute a “sex tape” per se as no one is actually engaged in any sex acts, on that account he may be right. But a nekkid video is a nekkid video, no matter how you try to explain it away:

It didn’t take long — TMZ has learned there’s already a legal war raging over the Eric Dane, Rebecca Gayheart naked threesome tape. Legal pit bull Marty Singer, who reps Dane and Gayheart, tells us he will sue anyone who publishes the video, which he calls “a private, confidential tape.” Singer says he just spoke with third wheel Kari Ann Peniche and asked how the tape got leaked. Her response: “I have no idea. I had nothing to do with it.” As for reports there’s a full-blown, uncensored sex version of the tape, Singer said, “From what I’ve seen it’s a naked tape, not a sex tape.” Singer added, “At most it’s 3 people maybe wanting to have sex.” And that’s why we love Marty Singer.

Looking stunning and dressed for the occasion, provocative cover girl Jennifer Aniston worked the red carpet with costar Owen Wilson at Thursday’s Los Angeles premiere of their comedy Marley and Me, at the Mann Village Theater in Westwood. Summing up the film’s universal appeal – Marley is a tale about a dog – Aniston, 39, called it “a true story, about a family and their life.” With nearly everyone also interested in the tale behind Aniston’s new eye-opening GQ cover, the star was asked what sort of message she was trying to send by wearing nothing more than a necktie for the magazine. She replied, with a laugh: “I wasn’t trying to make any kind of statement!” Aniston’s boyfriend, John Mayer, did have something to say, on the other hand. Arriving about 10 minutes before Aniston and Wilson, the musician told reporters that he was there to “support my girl.” Meanwhile, Marley costars Eric Dane and Alan Arkin also spoke up – in support of Aniston’s GQ pose. “I’m going to renew my subscription,” said Dane. “”She always looks fabulous, she will look fabulous at 50.”

LOL … I think that fabulous at 50 comment was meant as a compliment even tho it kinda doesn’t sound like one. While Brad’s premiere culled together all of the Hollywood A-Listers, Jen could take comfort in the fact that Kristin Cavallari of Laguna Beach: The Real Orange County fame deigned to make an appearance at the event ;) Honestly, I doubt Jen cared who was there as long as she had her boo John Mayer there to lend his support. Jennifer Aniston is on top of the world these days … she seems to be everyone’s topic of conversation, whether she likes it or not. It is really great to see her looking so happy. Yeah, basically it’s just an excuse to post pics of Michael Phelps standing around in his tiny little Speedo. And, for the record, I stand by my assertion that Phlepsie was hilarious in this little spoof … how can you not lurve a man who has no problem showing off his hot bod while wearing only a Speedo and not much else (tho, I could do without the black socks and Crocs combo).
