Remember last May when Amanda Bynes was arrested for allegedly resisting arrest and throwing a bong out of the window of her NYC apartment (I mean, who could forget that pair of ratchet mug shots) resulting in her eviction from the premises? You may recall that in July she strutted into court to plead not guilty to the charges and then, shortly thereafter, she was committed to a mental hospital and then rehab for the remainder of the year. Well, her case is due back in court tomorrow but the prosecutor has decided that IF Amanda continues her good behavior over the coming months, the whole criminal incident will be completely dismissed.

Cops had claimed they came to Amanda’s unit after getting complaints from neighbors she was smoking weed. Cops say they smelled weed in her unit and before they could do anything she threw a bong out the window. Amanda — who said she threw a flower vase and not a bong — was charged with marijuana possession, evidence tampering and reckless endangerment. Law enforcement sources tell TMZ … the case will be resolved tomorrow in court. Here’s what will happen. The case will be put on ice. Amanda will NOT enter a plea. If she keeps her nose clean and continues her therapy for the next 6 months, the charges will be formally DISMISSED and the case will be sealed. The fancy legal term — Adjournment in Contemplation of Dismissal. One reason the case is essentially being dropped … cops didn’t retrieve the glass for days, which means there’s no proof what they eventually found was thrown by Amanda. Our TMZ producer spotted the broken glass first, which looked like a bong, but the evidence was contaminated by weather, time and cigarette butts. We contacted Amanda’s lawyer, Gerald Shargel, but he had no comment.
Yeah, the district attorney had major problems prosecuting this case due to the evidence contamination after the fact. Amanda said she threw a vase out the window, they probably couldn’t prove that she was lying so … this sounds like the best option. Amanda has been doing very well since she was released from rehab last month and there is no indication that she won’t continue to do well over the next 6 months. As crazy as this bong-throwing thing was, it really doesn’t matter in the scheme of things right now. Amanda still has other legal issues to tackle but it looks like this particular incident won’t be an issue for her any longer.0
