Halle Berry’s Ex Gabriel Aubry Arrested After Brutal Fight With Halle’s Fiancé, Olivier Martinez

C’mon now. Don’t act like nobody ever got arrested (or should have gotten arrested) during one of your family gatherings! Oh boy… but seriously. This isn’t funny, y’all! Not too long ago, Gabriel Aubry won his custody battle against Halle Berry and a judge ordered Halle to stay in the states with their daughter Nahla, rather than move to France (where her fiancé Olivier Martinez currently lives). But all that is about to get shook up because on Thanksgiving morning Gabriel and Olivier got into a GINORMOUS fight after Gabriel dropped Nahla off at the house. Both men were hospitalized and Gabriel was arrested for battery. Damn, Halle’s got some serious Babydaddy drama! Get the deets inside.

TMZ has the blow-by-blow report:

Gabriel Aubry was arrested Thanksgiving morning after a melee at Halle Berry’s house, which sent both Gabriel and Halle’s fiance Olivier Martinez to the hospital … TMZ has learned.

Law enforcement sources tell TMZ … Gabriel showed up to Halle’s house with Nahla for a custodial hand-off. We’re told Gabriel was still in the motor court (a rich person’s word for a giant driveway) when Olivier walked up to him and said, “We have to move on.”

According to witnesses, Gabriel then pushed Olivier and threw a punch at his face, but Olivier blocked it and the punch struck him in the shoulder instead. We’re told Gabriel then pushed Olivier to the ground, and Olivier cold-cocked him in the face, and a struggle ensued, ending with Olivier pinning Gabriel to the ground.

In the struggle, Gabriel suffered a broken rib, contusions on his face, and possibly a more serious head injury. Olivier may have broken his hand and suffered neck injuries as well. There are conflicting accounts as to whether Gabriel was rendered unconscious in the fight.
Police were called and Olivier made a citizen’s arrest for battery against Gabriel. Gabriel was escorted to the ER and, ironically, Olivier went to the same ER an hour later. The two were just down the hall from each other.

Law enforcement sources tell TMZ … a judge has issued an emergency protective order, which requires Gabriel to stay 100 yards away from Halle, Olivier, and Nahla.
And finally, there’s this … specifics about the argument between Gabriel and Olivier are sketchy because they were trash talking each other in French.

It’s pretty shocking — considering Gabriel was out with Nahla just last night for a movie date at the Grove.

Gabriel was later released from the hospital and taken to jail where he was booked for misdemeanor battery (mind you, this is ALL happening on Thanksgiving Day). He posted $20,000 bail and was released around 6 p.m. last night. Olivier was released from the hospital around 3 p.m. and went home to Halle.

Now, pleeeeaasse do not judge me… but… I was kinda, sorta, into the idea of the two of them fighting (as long as Nahla was in the house the whole time, which I really hope she was). That’s messed up I know! I knooowww! But c’mon! Two hot guys arguing in French and then fighting… in French?! LMAO. Y’all know I love me some French cinema; this is like some kinda sexy French movie thing and I was into it for like 22 seconds.

But in reality, this is bad, bad,  bad. TMZ has photos of the injuries and X17 online has pics of Halle fleeing the scene with Nahla. Soooo bad. I noticed some people are suggesting that Halle might have wanted something like this to happen, might have even wanted to push Gabriel’s buttons in hopes that he’d lose his temper. I dunno y’all. This ish cray.

What do you guys think of Halle Berry’s Thanksgiving spectacular?

My first thought was that Oliver provoked him. I mean, come on: “We have to move on”? That’s what Gabriel would be saying to them, because I imagine they’re all bummed about not being able to run away to France as if Nahla’s dad doesn’t matter.

  • Ella

Serenity we have to listen to all sides here. And though the idea of taking a child away from it’s father is drastic, we also have to realize that sometimes it’s necessary. Maybe this mess is exactly why they wanted to run away to France. We don’t know. We don’t know what kind of guy Gabriel is. Oliver has to live with the fact that they have to stay put. What would provoking Gabriel do?

It’s just sad that Nahla is caught in the midst of all of it

    • Serenity

@Ella Provoking Gabriel would result in this, which they can use as ammunition to say, “See? It’s okay for us to leave the country!”

As for Oliver having to live with the fact that they have to stay put, he should have accepted that as a possibility when he got together with Halle. Running off and having their own lives off in France would be fine if there wasn’t a child to take into consideration. She seems to have shown a lot of disregard towards the father of her child just because he’s in the way of what she wants.

I’m actually leaning towards Gabriel’s side, because Halle has more fame and money than he does, right? That sort of thing can buy a person a lot of concessions, yet he still won in the courts.

    • Ella

It”s very clear you are on Gabriel’s side. I’m just trying to say you can’t just choose sides based on what you imagine happened and what your opinions of people with fame and money are.

All the adults in this situation are acting badly. People who are watching are “taking sides” like it’s a game. Who’s on Nahla’s side?

    • Serenity

I’m also on Nahla’s side, which is part of the reason I dislike what Halle has been trying to do. Halle and Olver want to go (back) to France. Did Halle stop and think about how that little girl might feel, not being able to see her dad easily or regularly? It doesn’t seem like that.

    • Matthew

While we don’t know what type of person Gabe is, we do know that he loves his little girl. We know that he has had to fight to get equal custody. We know he got that, so whatever type of person he is, our legal system seems to think he is an alright father.

We know they recently went to court again to determine if Halle could take her daughter and go live with her lover on another continent. The judge denied this, giving Gabe another victory.

Then fresh from his new victory, an angry Gabe storms into Halle’s peaceful home and attacks Halle’s lover in front of a terrified Halle and a vulnerable Nahla. Hmm. Something is fishy here. Unless Gabe is just plain bipolar.

    • Leah

Agreed! Timing and patterns are way off here if this went down as reported.

  • Jane

there is something not right about halle berry – i don’t trust her and i think that she was itching for something like this to happen so that she could be seen as the good parent. its just vindictive to take your baby away from her father, especially if he wants to be involved and loves her and cares about her well being. this smacks of Halle following a man who has a track record of being a serial monogamist(wow kind of like halle berry…) when people are under stress they do stupid things and it sounds like he just couldn’t take it anymore…i’ve wanted to smack olivier martinez many times myself and i don’t even know him…

  • Joan

I feel like there’s a HUGE chunk of info missing between the “We have to move on” and Gabriel pushing Olivier and throwing a punch… Did that really escalate THAT quickly? I’m not buying it. Something else must have been said or done there.

But I’m slightly mesmerized by the whole spectacle as well, Shannon. LOL This is crazy! And damn, did Olivier really messed him up that bad? Looking at Olivier I wouldn’t have expected “broken ribs” and “head injuries”?! Say what?! But anyway, I feel Gabriel is at a serious disadvantage here. I feel like he is the one that has more to lose …seems like he always is … and having the altercation at Halle’s house isn’t going to help him much either.

  • nicole

i agree with Joan – somethings missing. Gabriel has kept pretty calm with all the things Halle & her camp have put out there..something more had to be said. that doesnt excuse what Gabriel did though, but a part of me is kind of like – theres only so much one man can take in this situation. personally, i dont think this is a reason to reverse the no move order or to keep Nahla away from her father for along time. sometimes, these things happen but it could just as easily say to keep Nahla away from Oliver.

and another thing..Oliver shouldn’t be saying at all. even though he’s engaged to Halle, it’s not his child and needs to leave things between Halle & Gabriel.

what i dont get is, the courts know theres bad blood between both sides, why didnt they have them make an order to have a third party deliver Nahla?(like a family member or something) because lets face it, the whole word knew it was only a matter of time before something liked this happened.

  • nicole

booo my comment is pending *thumbs down*

  • Megan

I know think any of us really know what’s going on. I’m sure both parties are at fault. It’s sad that grown adults act like children when they disagree.

  • Chris

This seems really fishy to me too. I wonder if Halle Berry & Olivier Martinez planned to provoke Gabriel Aubry in an attempt to make him seem like an unfit parent so they could get their way and move to France. Poor Nahla. Either way, she’s living part time with a crazy person.

  • Leah

How did Olivier make a citizen’s arrest? He’s not even a citizen here. This whole deal is fishy.

  • Matthew

That’s actually pretty hilarious. The French citizen mad a citizen’s arrest on the Canadian citizen. Great.

  • Alys

I do not trust Halle farther than I can throw her. I suspect this was arranged on her part because she’s not happy with the ‘I’m not safe in the US’ verdict being turned down.
