The story of Kate Middleton‘s topless photos has kind of taken over the world, if only for the moment. Everyone’s talking about it and we’ve heard a lot of different views on the issue of privacy for celebrities and members of the Royal Family. It’s really interesting to see now, how this story is affecting other celebrity news as well. We’ve been following Halle Berry‘s custody battle with her ex-boyfriend Gabriel Aubry, which is centered on Halle‘s desire to move to France with full custody of their daughter Nahla. Now we’re hearing that since Kate Middleton‘s photo scandal was brought on by French paparazzi, Halle‘s claim that living in France will pose less of a paparazzi issue may be challenged. Halle Berry may be collateral damage in the publication of the Kate Middleton topless photos … TMZ has learned.

Halle’s lawyer has been trying to convince the judge in her custody battle with Gabriel Aubry … Nahla is better off living in France with her mom because the paparazzi are more gentile and respectful of celebs.

Gabriel’s lawyer had only one real piece of ammo to counter Halle’s claim — the paparazzi chasing Princess Diana to her death.  But that happened 15 years ago.  Now Gabriel’s lawyers have new firepower — the pics taken of Kate Middleton were by an intrusive photog who we’re told used a telephoto lens to capture intimate shots of her on a secluded balcony.

We’re told Gabriel’s lawyer is aware of the new Kate photos and it’s almost certain he’ll raise the issue when the trial resumes.

Of all the things that might have happened following the publication of those photos, this is not something I would have expected. TMZ goes on to say that Halle Berry really has the upper hand in all this, having had primary physical custody of Nahla since she was born. But many of us have pointed out that since Halle‘s fiancé Olivier Martinez lives in France, it’s very difficult to believe that her desire to move there is solely based on concern for Nahla‘s safety.

Do y’all think Kate Middleton‘s story should be brought into the courtroom for Gabriel Aubry‘s defense? It’s going to be interesting to see how it all plays out, and whether or not a seemingly unrelated scandal like Kate‘s might affect another family, like Halle‘s.

    It can be argued that no matter where Berry and Nahla end up, their privacy will be in jeopardy. These days I’d like to think celebs aren’t physically in jeopardy, so much as they are in mental jeopardy. That is to say, the mental pressure for some to have to deal with the intrusive antics of these “photographers.” Not all who we give the title celebrity to can and should have to deal with the stress constantly being followed brings. This includes women who happen to fall in love with royals and children, who did not sign up for celebrity. It’s creepy and troubling how the public’s fascination with celebrity progeny translates into these children being scrutinized before they know what that word even means.

    Of course there are going to be paparazzi in any country in the world. That’s the world we live in, but someone would be a complete moron and grasping for straws to say that any other country in the world is as bad as the U.S. when it comes to paparazzi. Though it really isn’t even U.S. as a whole, it’s specific cities. Can’t say that hundreds of paparazzi are hanging around Alabama or even northern California.

    When a celebrity chooses to live in L.A., NYC or Miami, they accept that this is a way of life for them.

    • @Nathan – i totally agree. theres a million places in the US that she can move to instead of going all the way to France & moving the child that far from her father.
      lets face it, the only reason why france is on her radar is because of who shes engaged too.

    She’s not moving to France to be with Olivier. She is movin to France to block custody and physical visitation between a father and a daughter. I don’t like what she’s doing.

    I hope the judge says she can’t go to France. She’s not going for Nahla’s safety it’s to keep her away from Gabe. If she wanted to get away from the paps in the US she could move out of LA. That would help a lot.

    @AmandaMarie and Diva-
    While it seems heartless to want to keep a child away from it’s father, we also have to keep in mind that Gabe may not be the best guy to have around Nahla despite shared DNA. We’ve heard stories about how ugly things have gotten between the parents and certain things that have allegedly been said-including some racially hateful things on Gabe’s part. If I was in Berry’s shoes and assuming those allegations are true I’d be nervous about having my mixed child near the father as well.
    It’s an ugly situation all around and I really hope both parents do what’s best for Nahla. This isn’t the first ugly custody case and sadly it won’t be the last.
