It looks like Halle’s pulling out the big [sexy] guns this time. According to sources, the actress– who is currently fighting her ex-boyfriend Gabriel Aubry for full custody of their daughter Nahla– is planning to bring her fiancé into the court room as a witness. Olivier Martinez currently resides in France, which is where Halle would like to live with Nahla. Apparently, he can testify to France’s overall safety, particularly for celebrities and their children. We heard about some drama in the courtroom with these guys the other day, and a few people commented on the ridiculousness that is Halle trying to convince a courtroom that her move to France would be for Nahla’s benefit only, when there’s a good chance that all of this is really about Olivier. Halle Berry has a secret witness she’s going to call to the stand to support her bid to take Nahla to Paris — her fiance, Olivier Martinez.
Sources close to the case tell TMZ … Halle’s lawyer will ask Martinez — a famous actor — about his experience with paparazzi in Paris. Martinez will say the photogs are far more respectful and less aggressive in gay Paris than their counterparts in the US of A.
Martinez will also discuss their living arrangement and his involvement with Nahla. He will also tell the judge that Halle is a class A mother.
As for how the case is going, we’re told baby daddy Gabriel Aubry is having trouble making his case. On Thursday, one of Halle’s expert witnesses left the courthouse early without even testifying — he was there to counter one of Gabrel’s experts, but there was no need for a rebuttal because sources connected with Gabriel tell TMZ … his expert kinda crashed and burned.
I’m gonna go ahead and assume that Halle’s lawyers know what they’re doing… but it seems strange to have Olivier testify as a credible witness. I mean, he clearly has his own motives here; of course he’s going to say France is awesome (I’m pretty sure it is) and of course he’ll testify that Halle is an amazing mother. But Halle also had her good friend Salma Hayek testify, so maybe this is just how custody battles go down in the celeb world. It’s kind of like the real world, where very little of the goings-on seem relevant to the child’s well-being.
But, regardless of what TMZ is reporting about Gabriel’s witness fail, I think Halle’s gonna have a tough case to make. The HuffPost recently shared report from Radar Online, and it really looks like things might go Gabriel Aubry’s way:
According to the website, the child custody report recommends that Nahla “shouldn’t be separated from her father,” and that will be a big factor for the judge to consider when he makes his ruling.
A source explained that the report makes it clear that separation from Aubry would be detrimental to Nahla, as he is a huge part of her life.
“The child custody report takes both Halle and Gabriel to task for not being able to put aside their personal issues for the sake of their little girl. The evaluator also expressed concerns about this being Halle’s third marriage to French actor and citizen, Olivier Martinez,” added the insider source.
The former couple, who split in February 2010, have been in and out of court for months battling over custody of Nahla, and so far, Berry hasn’t fared well. In June, TMZ reported that a family law judge ordered Berry to pay Aubry $20,000 a month in child support.
Berry asked the court for permission to move to France, claiming that she fears for her life now that Richard Franco — the man who was convicted of stalking Berry, is out of jail, while Robert Hoskins, a man who allegedly threatened to slit Berry’s throat, briefly managed to escape from a mental institution in February.
