Lindsay Lohan Appears In Court Again, Gets More Time To Consider Taking A Plea Bargain
Judge Keith Schwartz Is Losing His Patience

Lindsay Lohan was back in court today in the continuing matter of her felony grand theft case and the whole thing was pretty much blink and you missed it. L. Lo was in and out fairly quickly, because nothing of any real substance went down today. Lindsay went before Judge Keith Schwartz and did NOT take the plea bargain deal (that comes with jailtime) … but the judge did give her a bit more time to reconsider. She will have to go back to court later this month and either take the deal or not … but if she does not take the deal and decides to go to trial then Judge Schwartz will then determine if she violated her probation and she will have to go to jail until her trial can begin. Homegirl’s got jail in her future, whether she likes it or not.

Lindsay Lohan’s judge is pissed … that TMZ got information about his sentencing recommendation even though he wanted it held confidential … this, as he has given Lindsay more time to mull over his sentencing offer that WILL involve jail time. Judge Keith Schwartz was beside himself, saying he told lawyers on both sides to keep the sentencing proposal under wraps. We posted a story shortly after the meeting, saying the judge would impose a sentence — possibly 3 months in jail — if Lindsay pled guilty or no contest … The judge has sent the case to another judge — Stephanie Sautner — for a preliminary hearing, but he’s giving her one more chance to accept his offer. Lindsay will be back in court before Judge Schwartz on March 25, and she can plead either guilty or no contest to the grand theft charge. If Lindsay doesn’t accept the plea, Judge Sautner will hold a preliminary hearing on April 22. At the same time Judge Sautner will decide if Lindsay violated her probation — and it’s virtually a sure bet the judge will rule Lindsay did indeed violate it. At that point Lindsay will go to jail as she awaits trial.

It’s very obvious that Judge Schwartz is losing patience with Lindsay … it’s also pretty evident that he wants her to take the plea bargain so the theft matter can be taken care of once and for all. Irregardless of whether she takes the plea bargain or not, she will still have the matter of probation violation to deal with … and it’s almost certain that she will be thrown in jail for some bit of time for that infraction. I suppose it’s possible that Judge Schwartz might be lenient with Lindsay on the probation violation matter IF she takes the plea bargain … with jailtime. I mean … in all likelihood, Lindsay is going to jail at some point. I guess we’ll have to wait until March 25 to find out how this all plays out.

Oh … and by the way … WTF? was up with Lindsay‘s outfit? It looks like her dress is made out of latex, or a condom. On the plus side, it was a more conservative court look for her so … win?

    Agreed on the outfit. She tried to be more “conservative” for court, but failed. It looks like a conservative dominatrix.

      I really don’t like the dress. It is the color of death and would have looked better if it was a warmer beige, IMO. Washes her out.

    But if she’s not guilty, why should she take any deal? I don’t understand your legal rules, but it seems to me like the judge is saying she’s guilty whether she is or not? And if she’s not guilty, how has she broken her parole? Just because someone says she’s done something wrong? Again, not a fan of hers, I just don’t like seeing anyone get victimised. If she’s guilty…lock her up!

      @Debho — She may or may not be guilty for the theft. That is a separate matter. The fact that she was arrested while on probation is a clear probation violation — punishable with incarceration. It sounds like the judge is not happy with the way she is hogging up the legal system so he’s trying to get her admit her wrongdoing and pay for the crime. In any event, she will likely go to jail — either for the theft or for the probation violation.

        I understand that, but if she’s not guilty, then shouldn’t the fact that she was arrested be thrown out? It’s not her fault that someone has made these allegations against her. It seems to me that in this case, she can’t win. It’s like she’s been bullied into pleading guilty just to get rid of her.

But when a person is on probation they are free from incarceration on the condition that they stay out of trouble, meeting with their probation officer regularly and/or taking drug tests to ensure they are on their best behavior. People on probation get freedom as a courtesy. It may seem unfair that if someone gets falsely arrested they are in violation of their probation but that is what “probation” means.

    The DA and all those involve on that side want Lindsay to take the Plea deal. It’s a easy win for them. Lindsay should not take the Plea Deal because fighting the charges in court will be an easy win for her. The DA has no chance at winning in court. They have no case.

    But yea she’s still going to jail thanks to the fucked up injustice rules we have set for those on probation. Probation Lindsay shouldn’t even be on. She went to jail she did her time for them to add Probation time just becuase The Jailhouse decided to let her go early is just bull shez! But whatever moot point now.

      No she should be on probation. Once you leave prison, you go on probation. That’s just the law everywhere (I imagine). It’s supposed to be a deterent for those who can’t keep out of trouble. Lindsey is a prime candidate for this. What I think is wrong is that people can allege she’s done something wrong and even if she’s proven innocent, she still cops trouble for it even if she (or any other person in this situation) are keeping out of trouble. They don’t want the courts clogged, yet they don’t seem to have the right laws to remedy this.

    So, so tired of hearing about this. It’s not that hard to stay out of trouble. Good lord. I was on probation myself once for public intox (darn you $0.25 beer night) and I stayed clean. It’s not hard. She has continuously put herself in situations that she shouldn’t, and it seems to me like she just doesn’t give a hoot, and she is just begging for trouble. Regardless of whether or not she stole the necklace, it’s her own darn fault for creating a situation where the accusation is even possible. No one is that stupid. Ugh. And about the whole ‘tea fermented with alcohol’ thing, I can bet you she knew what she was doing. And the shady circumstances that surrounded her whole situation in her latest stint in rehab…. I dunno. Apparently this turned into an incoherent rant.

    Sorry, Trent! I am just so fed up with her and her supposed feeling of self entitlement! And yes, the dress was awful. It completely washed her out. Not something she needs to wear with her skin tone and that unflattering shade of blonde hair that she sports. Yuck!
