Lindsay Lohan Refuses Plea Bargain, May Go To Jail For Her Theft Charge [UPDATE]

Lindsay Lohan appeared in court this morning to go before the judge, again, for the ongoing case of felony grand theft brought against her. L. Lo, in a plunging neckline, showed to court and was in and out relatively quickly. The District Attorney arguing the case against Lindsay has offered a plea bargain to settle the case but because any bargain on the table would require jailtime, Lindsay refuses to take the deal. As a result, the case will go to trial and this saga of the stolen necklace will continue.

Lindsay Lohan just got the word from the judge — if she accepts a plea bargain, she WILL go to jail. TMZ broke the story this morning … the judge will throw Lindsay in jail if she accepts a plea bargain. Judge Keith Schwartz told the famous defendant bluntly, “I don’t care that you’re Lindsay Lohan.” Judge Schwartz did not say how much jail time Lindsay would do if she cops a plea. And, Judge Schwartz wants a psychological evaluation that will help him understand what makes Lindsay tick and what particular sentence is appropriate. The judge explained … if Lindsay pleads guilty or no contest, it will be an automatic admission she violated her probation. And the judge announced what TMZ first reported … Deputy D.A. Danette Meyers made a formal offer to settle the case. Lindsay’s lawyer, Shawn Holley, will noodle over the offer before deciding, but the judge indicated Lindsay’s probably not going to accept the D.A.’s offer. As we reported, Meyers wants significant jail time. If Lindsay doesn’t accept a plea, she’ll stand trial and if she’s found guilty she could get 1 year in state prison. Lindsay is back in court on March 10. She has the option of pleading guilty and basically throwing herself at the court’s mercy.

It’s looking more and more like Lindsay will be going back to jail at some point. The only way she can avoid jail, I think, is if she is able to convince the court that she did NOT steal the necklace by winning her case. If she takes any plea bargain, she is going to jail. If she loses her case, she is REALLY going to jail. But, Lindsay seems hellbent on proving that she didn’t steal the necklace so … onward goes the case. She does have the option of changing her mind between now and March 10 (the date of her next court hearing) but it sounds like she wants no part of any deal that means she will have to go back to jail.

As for the circus earlier today, I was very surprised to see that Michael Lohan was at court considering he was just in Florida yesterday. Lohan flew in (where he was counseling rehabbing teens, if you can believe it) this morning so that he could attend the hearing in support of his daughter:


If there are lights, cameras and microphones, you better believe Michael Lohan can’t be far away. But, getting back to Lindsay … today’s court hearing was pretty in-and-out. Her next court date should be more significant. If she totally refuses to plea bargain and/or plead guilty, she is going to trial! And another Lohan courtroom saga will commence.

UPDATE: Oh yeah, it’s really sounding like Lindsay will be going back to jail sometime soon. It turns out that the District Attorney’s plea bargain deal involves 6 months of jail! Now we know why Lindsay is adamantly refusing to take the deal. And, even if she does go to trial and is found not guilty, she’ll still have to be punished for violating her probation … which means jail:

Sources connected with the Lindsay Lohan case tell TMZ … the offer Deputy D.A. Danette Meyers made to Lindsay’s lawyer in chambers was SIX MONTHS in jail. Judge Keith Schwartz said in open court he had a feeling Shawn Holley would pass on the D.A.’s offer. That’s because Lindsay will not accept jail time — at least not now. But here’s why we’re almost positive Lindsay will eventually cop a plea. She is going to jail no matter what. The judge ruled Lindsay’s preliminary hearing and probation violation case will be heard at the same time. At the end of the preliminary hearing, if the judge feels it’s more likely than not that she stole the necklace, Lindsay will be thrown in jail immediately while she awaits trial on the grand theft case. So even if Lindsay is ultimately found not guilty at trial, she’ll still be in jail for the probation violation. Short story … it’s likely Holley will plead guilty or no contest on behalf of her client, and then hope the judge gives Lindsay less than 6 months.

Homegirl is screwed. It’s unlikely she’ll get 6 months in jail but, yeah, she’s very likely going back to the pokey for at least some sentence of time. Dang.

    Dina was there so was Lindsay’s brother Michael jr. I saw them on tmz’s live feed when Lindsay was leaving court.

    To be honest , from certain reports i heard she was truly set up by the jewellery shop . Its such a shame her name has been tainted again as it looked for a while there like she was getting things back on track .

      @wilbur — LOL! I find it very hard to believe that she was “set up” by anyone. And I’m not sure what you mean by “getting things back on track”. Not 2 weeks after she got out of rehab, she was in trouble again.

      Assaulting rehab nurses after being suspected of drinking isn’t exactly what I would call getting back on track. She has a history of taking things that don’t belong to her, so I highly doubt that anyone set her up. The store wants other celebs to spend money there…framing stars wouldn’t be the best marketing ploy.

    It’s Oscar party weekend. It’ll be amazing if Hohan makes it through without a drug or a drink. I can’t stand the girl, but I doubt she stole the necklace. She gets so much stuff for free and for the asking, I don’t see her stealing.

      Why do you doubt she stole it? The money is most likely not the issue or cause for stealing, the issue comes from the sense of entitlement and she was probably seeking a thrill. Either way, I don’t think she is getting out of this and that is a good thing!

      I gotta completely disagree. She’s stolen before and in my opinion, it’s BECAUSE she gets things for free. She is an entitled little (enter words I want to say but can’t).

      I don’t think anything will help her, probably not even a year in jail, where she’ll no doubt spend her time feeling sorry for herself and coming out more pathetic than she went in.

      you don’t see her stealing? um what about everything else she has stolen in the past couple years? a fur coat, almost every article or clothing from a girls closet, i’m sure im missing a lot more here. the girl is a thief and while she may get a slap on the wrist for everything she does, she thinks she can get away with it all. she wont stop until shes seriously punished.

    I think the girl is bi-polar. She shows so many traits it’s not funny. She has told herself so many times that she didn’t steal the necklace that she believes it.

    i think she should just suck it up and take what’s coming to her with DIGNITY. not only would it show the courts that she’s grown the f*ck up and can be a responsible adult (which, i’m sorry to say, also includes taking responsibility for one’s actions), but it will probably help her out with shortening the duration of her sentence in the long run. she NEEDS to go to jail (or prison) and get her damn life back on track. she gets away with EVERYTHING with a little slap on the wrist and has no regard, let alone RESPECT for the judicial system – i mean who the hell goes to court with “fuck u” written on their freshly manicured fingers when you KNOW there will be cameras everywhere?! but she still got away with it. people have gone to jail and/or prison for MUCH LESS and she’s really starting to run out of those get-out-of-jail-free-cards. ultimately, this girl is a constant hot mess, regardless of her f*cked up parents, she’s still an adult, she still committed her crimes/violations, and as an adult she has to pay the price. what a shame. *smh*

    I’d be surprised if Lindsay goes to jail. If she does, she’ll go in and out in a matter of a few hours. This girl is never going to learn. At least this judge is telling her he wants to see her get her life in order and stop screwing around. Of course, we all know how she is, she does what she wants, because she wants to live her life however she wants to.

      paris hilton and her family are much more powerful than lindsay lohan… if she went to jail for that long, im sure lindsay will as well.

    the girl needs time off from getting into trouble. jail looks like a great place to stay out of trouble caz shes obviously not capable of it being on the streets of los angeles.

    Somebody please just cut the girl a break!!IMHO This girl has been through the ringer. She has made mistakes, we all do, but for her everything gets amplified by the public microscope she is under. She is learning as she goes. I think she has suffered enough. I also think that the book has been thrown at her enough. She is being made an example of, sure she has screwed up many times and screwed up hard, but they villify her and she gets the strictest punishment there is. Streetwalkers, pimps, and hardened criminals don’t have to deal with these repercussions. I swear.

    So, I am no fan of hers, but I do find it disturbing that a judge can just decide she has violated her parole even if she is found not guilty of the crime. (A crime which she would have to have done in order to have violated her parole, right?)

    Sometimes I really hate that judges have so much power. I think some of them really get off on it. Ofc, that does not mean she is or isn’t guilty of stealing. It just seems weird that she could be found not guilty, yet in violation of her parole. Weird.

      @tiredofLiLo — The fact that she was arrested is a violation of her probation. It’s not a matter of the judge deciding that she violated. If a person gets arrested while they are on probation, they are in violation.

    @Trent I don’t live in America so I don’t really get the probation violation thing…
    Did the store have to show any evidence before she got arrested? Coz couldn’t people go around claiming someone on probation committed crimes just to get them chucked in gaol? :D
