Michael Jackson’s Last Will & Testament Has Been Released
Makes provisions for his mother Katherine OR Diana Ross to care for his children

The last will of Michael Jackson, the legal declaration by which a person, the testator, names one or more persons to manage his or her estate and provides for the transfer of his or her property at death, has been made available to the public after it was officially filed in court today in order for MJ‘s last wishes for his estate to be carried out. For the most part, the will offers no real surprises but a couple of interesting caveats. The will states that MJ‘s mother Katherine should gain guardianship of his three children but in the case of her death or inability to care for the children, it was MJ‘s wish that Diana Ross be nominated to care for the children instead. Also, the will makes plainly clear that NO PROVISIONS AT ALL are to be made for MJ‘s ex-wife Debbie Rowe. It seems very odd to me that he would decide to make no provisions for the mother of his two eldest children. Here is the first page of MJ‘s will along with some other deets from the document:

Michael Jackson’s will has been filed with the court. Jackson asks that his mother, Katherine, be made the guardian of all three of his kids. The will says if Katherine died before him or couldn’t serve as guardian, he nominated Diana Ross. And there’s a petition filed along with the will, saying Jackson’s estate is worth more than $500,000,000. The petition says almost all of the estate “consists of non-cash, non-liquid assets, including primarily an interest in a catalog of music royalty rights which is currently being administered by Sony/ATV, and interests in various entities.” As we first reported, the will leaves everything to the Michael Jackson Family Trust, stating, “I give my entire estate to the Trustee or Trustees…” The will declares that Jackson is not married. The will names John Branca, John McClain and Barry Siegel as co-Executors. Branca was Jackson’s lawyer, McClain is a music exec and Siegel was Jackson’s accountant. But Siegel resigned from his role as executor in 2003. Branca and McClain just released the following statement: “The most important element of Michael’s will is his unwavering desire that his mother, Katherine, become the legal guardian for his three children.”

It was widely reported before his death that Michael Jackson “promised” to relinquish control of the publishing rights to the Beatles music catalog (which he acquired in the 80s after he outbid Paul McCartney and Yoko Ono for those rights at auction when they went up for sale) upon his death … as yet, no such provision has been found anywhere in MJ‘s will. My guess is that the relinquishment of those publishing rights to their rightful owners (ie. the Beatles) will never happen. If you are at all interested in reading all 5-pages of MJ‘s last will you can download a copy HERE and check it out for yourself. Honestly, there’s nothing really of surprising note in the doc. As mentioned above, it seems that the overriding concern in the document is the care of his three children.

I wish that Diana Ross would get those kids. I mean really…the Jacksons don’t exactly have the best track record for raising normal kids. (I’m just sayin’) And Diana Ross’s kids that I know of are pretty well adjusted….

I did not know that he and Diana Ross were so close, but I agree that she would be better for the kids than the Jacksons. Mostly b/c I fear his father will treat them like he did his own children. If they did go to a family memeber, I would go w/ Janet b/c she seems like the most stable of the bunch.

it still pisses me off that he outbid yoko and paul for the catalogue. they should get that back. seriously, seriously get that back. :/

  5. @ Chelsea…I agree that Micheal’s parents should not get custody of the kids, as like you said, they do not have the best track record. But Diana Ross? How Random!.However, could not one of the 104 brothers or sisters take custody? There has to be one of the Jackson’s that has good child rearing experience!!

  6. Opps…last comment was meant @ SuziLee not Chelsea :-)

I feel so bad for his kids. All of the rumors and junk being said can be harsh at times for them. I feel so bad that not only have they lost him but they are also having to deal with all of this crap for the rest of the world. I wish people would stop calling him names and stuff for their sake. He’s gone let him be. No matter what you think of him

And as for his ex there is obviously something about her that he does not like and does not feel the need to care for her in the least

Did NO ONE watch the Jackson 5 movie that used to run on VH1 alll time in the late 90′s??? Michael is very close to his mother and she was the normal parent, It was Joe who was crazy, which is why there is no mention of him in the Will. Also… it was very well known that Michael had a deep respect and admiration for Diana Ross and vice versa.

500 million?? There are going to be some people who are pissed they haven’t been paid!

I have a problem with Katherine gaining custody of those children. For a start, she’s elderly and surely has her share of health problems. Also, Joe Jackson still resides in the same house, so that would mean that he’d be around the kids. I don’t think Diana Ross should have them either…she’s not exactly young and also comes with some strange baggage.
Why weren’t one of Michael’s brothers or even Janet (not La Toya) given guardianship?

  12. Shelly says:

Although Debbie Rowe is the biological mother of MJ’s kids, I am not surprised at all that there are no provisions for her. She was more or less a surrogate to give MJ children than in involved mother.

  13. taylor says:

I read that Katherine and Joe have separate homes and have been estranged for years. They’re still married, but living separate lives- at least that is what I read in one article, but with the Jacksons who really knows!

I agree that outbidding Sir Paul- and to a lesser extent Yoko – for the Beatles rights was a pretty unforgivable thing to do. It ended his friendship with Paul McCartney.

  14. wishinchick says:

@Melissa I have seen that movie too many times to count! Yeah, I believe the Katherine and Joe are legally married but have been living apart for years. That movie made it clear that Katherine and Michael were pretty close.

Side note- that is one of the best tv movies ever made IMHO

  15. Sarah says:

Not really surprised that Debbie Rowe doesnt get anything. She wasnt involved in the kids lives or anything just a source of genes. I hope Joe Jackson stays the hell away from his grandkids and that his mother keeps it that way.

Diana Ross doesn not have some strange baggage, doofball, and her children have turned out very well growing up in STRANGE CELEBRITY WORLD. You’re spastic.

So wait, his oldest kid’s name is “Prince Michael Jackson, Jr.”? Umm, who is “Prince Michael Jackson, Sr.”?

  18. chinabaybee says:

Michaels children: Michael Joseph Jackson Jr., called Prince Michael I, Paris-Michael Katherine Jackson and Prince Michael Jackson II should be cared for by whomever he designated to care for them; which is his mother first and Diana Ross second. It just baffles me how everyone has an opinion about what should happen. No one really has any knowledge of anything that has happened in this man’s life. Only rumors, speculation etc. None of us are without our own baggage in some way or the other, but are quit to point the finger and criticize others. Quit gossiping about this man and his children for the sake of the children’s future and give them a chance at the most normal life they are able to have.

  19. B says:

I think it is pretty shitty if Paul and Yoko don’t get those rights back.

  20. Sharran says:

I’m with you chinabaybee..I say leave the man alone…he’s gone and left behind a WILL…stating what he wanted. I think they should abide by it . Like you said chinabaybee people are so quick to JUDGE…. What they should try to do is UNDERSTAND……..especially if they havent walked or in Michael Jacksons case moonwalked in his shoes. He left Debbie Rowe out for a reason and if seeing the video of her using such foul language doesnt convince you…GET A CLUE….. Besides ,she was paid off three times. Seriously , how many times do you have to pay someone off to get the point? Michael got it , thats why she was left out! For goodness sake.. let the man rest in PEACE. Sharran
