Chris Brown’s Legal Defense Is Starting To Show
Trying to get off the hook

As the court date looms for singer Chris Brown to face charges that he physically assaulted his ex-girlfriend Rihanna last February, a new report has surfaced that shows that his legal team — led by his attorney Mark Garagos — is preparing their case to try and have all charges against Brown dismissed on the grounds of the police’s mismanagement of evidence (ie. the leaking of the photo of Rihanna‘s assault injuries). If Garagos gets his way, the entire matter could be dismissed without Brown having to answer to the charges and could get off scott free:

Chris Brown’s legal team is on the move. The singer’s lawyer, Mark Geragos, filed a request in a Los Angeles court Wednesday seeking access to LAPD records, arguing that Rihanna’s injury photo – widely distributed on the Web – was “illegally leaked to the media” by police and may result in a case dismissal, RadarOnline reports. “I am informed and believe that this highly prejudicial photograph was sold by an LAPD officer to the entertainment website, TMZ,” Geragos states. “The photograph was immediately viewed by hundreds of thousands of viewers and was displayed on every news channel for several weeks … The purpose of the leak was necessarily for profit and to vilify Mr. Brown and poison the potential jury pool.” Geragos adds that if LAPD records show “dishonest conduct” by its officers, “I intend to use such evidence at the preliminary hearing to attack their credibility … I believe there is a reasonable likelihood that the case will be dismissed at the preliminary hearing.” Will Geragos’s gambit work? A judge will decide. But, says L.A. criminal defense attorney Jeffery Rubenstein, who’s not involved in the case: “It’s unlikely the judge will dismiss the case on the grounds of leaked evidence. It’s not police conduct at issue here, it’s Chris Brown’s.” Brown, 20, has pleaded not guilty to allegedly beating Rihanna on Feb. 8. A preliminary hearing, in which the court determines if there’s enough evidence for trial, is to begin within eight court days of May 28. But the case could potentially end with a plea bargain at any time.

I can’t say that I blame Garagos for taking this route to having the case dismissed … his entire job is get his client off as entirely and as quickly as possible. That said, it really will be up to the ruling judge to determine if the case should be dismissed. I agree, tho, that the issue at hand is not the behavior of the LAPD — it’s Brown‘s alleged assault against Rihanna. For the sake of justice, I really hope this case does not get dismissed. If Chris Brown really is “not guilty” as he asserts then he should welcome the chance to prove so in a court of law. My guts tell me that Brown will at some point work out a plea bargain. If the case looks like it’s going to trial, I think he’ll work out a deal (the prosecutor wants some amount of jail time) and face as little punishment as possible. I guess we’ll just have to wait and see.

he really disgusts me. if he was any other person in the world (i.e. not a celebrity) there’s no way he would get off the hook

  2. L says:

Legally, the police conduct does matter. He’s entitled to a fair trial, and honestly, with that photo leaking, it’s unlikely that he could get a juror who could be unbiased. There’s a big chance that this could get dismissed.

  3. Olivia says:

That is just bullshit…he should pay for what he did. The picture and police report should be enough. But then again Celebrities onyl need to show money and they get away with everything anyway,

  4. Zsofi says:

If the photo is no good evidence (‘cough’), why don’t they look at Brown’s hands or something?
When my stepfather hit my mom, and broke her nose, his hands were purple!!! Also, his watch showed that there was an actual hit.
However…The juries said that he had to protect himself (ha-ha!) and he was free after all. Nobody said that this was wrong or something…But that’s life.

  5. christine says:

the fact that there is a possibility nothing will happen to him is making me sick.

While I agree that he has the right to a fair trial, it is difficult to pin the blame on the police department for the leaking of the photo, anyone with access to police department computers could have placed the picture on the internet. That being said, it is important that Chris Brown realizes that he needs to own up to what he has done. If I was the district attorney I would make a motion to have the trial be done before a Judge only and closed to the public until a ruling is put on place. I don’t think that Chris Brown should be made into an example, however I don’t agree that he should get off without any form of punishment. Lawyers get paid to get their clients little to no sentences for crimes, but i think in this case the lawyers are a bit overzealous, and unfortunately for Chris Brown in the court of public opinion he has been found guilty… he may not have a career after this. I for one am on the side of justice for victims not for the criminals, and ultimately whatever the court does decide to do we, have to accept whether we agree or not.

  7. Tricia says:

Chris Brown, “See, I shouldn’t be punished because there is a picture of all the bad stuff I did and now people won’t like me – and that’s not fair!” Yeah – okay.
(Whoever leaked the photo can also be punished – but puh-lease!)

  8. Amy says:

I was hoping he would just fall off the face of the earth. I also think if his lawyers get him entirely off the hook, it will make him look even worse in the eyes of the public, by not taking any responsibility at all for his actions. I think having a little bit of accountability and some kind of punishment would be better for his career and peoples perception of him than trying to get out of it. Of course Rihanna isn’t doing much to help the case. I quit feeling sorry her a long time ago, because she doesn’t seem to care that she was used as a punching bag.

  9. I really hope he doesn’t get off scott free, that wouldn’t be fair. If he gets let go because he won the case that’s one thing but he should at least have to fight for his rights. I think it would be total crap if he was allowed to just walk away after what he did, that’s really just not cool, bottom line.

  10. javajunko says:

this is just bull shizzz!! Chris Brown pleading not guilty is like Courtney Love saying she’s perfectly sane. This guy is a piece of crap and not much of a man at all, he should accept the consequences of his horrible actions that he leashed upon Rihanna and its pretty cowardly that he is trying to get off on the fact that a photo was leaked, he still beat the shit out of a woman, and it was just a photo, how is that in any way really going to effect the case, I’m sure there are millions of people that don’t have a clue who this scum bag is that could be used for a jury…this is just sick and another example of the way celebrities get special treatment ….

  11. J. says:

Kristin and others -Actually domestic violence hardly ever gets harsh penalties and it’s not just celebrities. Normally, abusers get probation and if they do get a sentence, it’s almost always less than six months.

  12. Janelle says:

As Admiral Adama said, found not guilty does not mean he’s not innocent.

  13. nicole says:

You guys cant keep saying that it’s only going this way cause he’s a celeb. Ive read many cases in the news paper of “normal” people getting a lighter sentence or off because of leaked information & pictures. find me one person who hasnt seen the pics – its gunna be hard to find a unbiased jury.

  14. Tiffany says:

This is ridiculous! I saw the pic and it wasn’t just a tiny scratch on her cheek. Her face was beat down (!) and the fact that he could get off with just a slap on the wrist is outrageous! >:-/

  15. rossy says:

Rich or poor, famous or ordinary – not too many people in society take responsibility for their actions. Chris Brown should grow some brass ones & dump the lawyer, stand before the judge & speak the truth.

  16. Kristin says:

In the court of public opinion, i.e. my radio and iPod, he is guilty and will be banished.

  17. whatever man says:

Mark Garagos is a boil on the ass of all that is good in this world. How appropriate that he defended Scott Peterson, Chris Brown and Phil Specter.
