Howard K. Stern Shows Up In Court, Does Not Offer A Plea
Instead, will be arraigned next month

Last month we learned that Howard K. Stern had been arrested on charges that he and two doctors conspired to furnish drugs to the late Anna Nicole Smith before her death in 2007. Yesterday, Stern showed up in court NOT to enter a plea on the charges leveled against him but to petition the court to postpone his arraignment until next month (how very Chris Brown of him). Altho Stern had nothing to say inside the courthouse, his lawyer had much to say to the media outside on the courthouse steps:

A defense attorney used the courthouse steps Tuesday for a blistering attack against the California attorney general for bringing conspiracy charges against his client, Howard K. Stern, in the Anna Nicole Smith case. Stern, Smith’s longtime partner and attorney, appeared before a judge Tuesday on charges of conspiring with two doctors to provide drugs to Smith before her fatal overdose in 2007. He did not enter a plea but agreed to an arraignment date next month. Declaring Stern “innocent of baseless charges,” attorney Steve Sadow said after the short hearing that “no one enabled Anna.” “Anna made her own choices and decisions,” Sadow said. “No one told her what to do and when to do it.” California Attorney General Jerry Brown responded that Sadow’s “rhetoric is just smoke and mirrors, and is completely out of line.” “The fact is that the Bureau of Narcotics, the Drug Enforcement Agency, the State Board of Medical Examiners and the Los Angeles district attorney have all validated this prosecution,” Brown said in a statement to CNN. “These people are whistling in the dark if they think this accusatory rhetoric is going to save them.” Stern, Dr. Khristine Eroshevich and Dr. Sandeep Kapoor were charged last month in California with several felonies, including conspiring to furnish controlled substances, unlawfully prescribing a controlled substance and obtaining fraudulent prescriptions from June 2004 through January 2007, only weeks before Smith’s death. Smith, 39, was pronounced dead February 8, 2007, after being discovered unconscious in her room at the Seminole Hard Rock Hotel and Casino near Hollywood, Florida. A coroner said she died from an accidental overdose of prescription drugs. In announcing the charges last month, Brown said the doctors and Stern devised a plan to use fake names so Smith could be prescribed “thousands of pills.” The former Playboy playmate and reality TV star was drugged “almost to the point of stupefaction,” Brown said … Sadow said Stern relied on the “good judgment” of Smith’s doctors to prescribe drugs for “valid and legitimate medical reasons.” “Howard loved Anna with all of his heart and would never have done anything intentional to harm her,” Sadow said. Officials said that both prescription and over-the-counter drugs were found in Smith’s system, including three antidepressant or anti-anxiety drugs. Human growth hormone and chloral hydrate, a sleep medication, also were found in toxicology tests, officials said. Kapoor and Eroshevich also were charged with obtaining a prescription for opiates by “fraud, deceit or misrepresentation.” And each was charged with one count of obtaining a prescription for opiates by giving a false name or address, prosecutors said. Eroshevich, who was also in court, did not enter a plea … Kapoor was not in court, and his attorney did not speak. The case for all three defendants was set for another hearing May 13.

It is my personal belief that Anna Nicole Smith was drugged at pretty much all times … anyone who remembers what she was like EVERY SINGLE TIME she ever spoke — whether it be on her E! TV series or when she posted videos online or when she walked outside her front door — will prolly remember that she often had difficulty even speaking coherent sentences. To be honest, I was shocked that she managed to give birth to little Dannielynn Hope Marshall Birkhead without incident. There is no way that a woman that heavily drugged could be able to procure all of the medication she needed to stay, as Brown contends, “stupefied”. I never trusted Howard K. Stern in terms of his relationship with Anna Nicole. He entered her life when she began fighting for the billions of dollars that her 89+ year old tycoon husband J. Howard Marshall (of 10 minutes) left her in his will and he stayed with her to the bitter end, IMHO, hoping to enjoy a big pay off one day. The notion that he “loved” and “cared” for Anna Nicole Smith is laughable to me … but, these are just my opinions. Sadly, I didn’t bat an eyelash when it was reported that drugs were involved at all in Anna Nicole‘s death … nor did I flinch when I learned that Howard K. Stern was with her. I sincerely hope the truth comes out and that the guilty parties are made to pay for their crimes. Karma has a funny way of working itself out.

Can you enter a plea of “IDK”? I wonder if Dannielynn will end up being diagnosed with any disabilities. I certainly hope not, but I kinda doubt Anna-Nicole was off all drugs during her pregnancy.

  2. christine says:

i’m so glad him and the other 2 are finally being vrought to court. i have never liked him and he creeps me out in a major way. i hope he goes to prison for a long time

  4. Mike says:

anna didnt die of a drug overdose. she died due to sepsis after a intramuscular injection (i believe of antibiotics) ruptured an abscess and gained access to her bloodstream.

  5. Michelina says:

I think what happen to her was a tragedy and just hope her daughter is 100% ok!! If these ppl are respon for her death I hope they pay!!

  6. c'mon says:

All they need to do is show that video of her with the clown makeup which he filmed her high as a kite to prove he did it and allowed it.

  7. Posh says:

I hate to judge a person before there has even been any evidence provided but…guilty! Guilty, guilty, guilty!

  8. Anne says:

Larry Birkhead = douche + enabler as well

  9. Nikki says:

I still think he had something to do with her son Daniel’s death too- more money for him if she didnt have an heir – considering he thought Danilynn was his – (or at least was staging it)

  10. Gaby says:

I knew this fool was shady from the first time he was on that reality show with Anna Nicole. SHADY SHADY

  11. Michelle says:

I used to watch her show because really it reminded me of a car wreck… you don’t want to watch and yet you can’t look away. That man has been shady from day one and she’s been eating it up from the beginning… I hope the judges aren’t as dumb as she was!

  12. Kent says:

@Dana – I agree, I hope Danniellynn’s health is not compromised by Anna Nicole’s drug abuse

I have a question, how can the coroner state the overdose is accidental? I understand the declaration of overdose, but not the qualifier of “accidental”.
My gut tells me Stern is guilty as sin.

Anna Nicole wanted the Marshall case to keep going, but no lawyer would touch the case. But Howard K Stern took it on when no one else would and got it back going again. So she wouldn’t even have had a case to get the money if it weren’t for him. And you know what? He deserves to get money from the case, because he’s the one that worked on it! And all this about how he was leaching off her money.. please. She didn’t even have that much. All he got was room and board and to be her step and fetch it. Sure he may have been an enabler, but so was everyone around Anna including Birkhead. As for him keeping her drugged up, she was whacked out way before she even met Howard. There’s no proof of him killing Anna or her son and it’s wrong to post about him being guilty when you really have absolutely no clue what went on in their life. Believe what you want, it’s your opinion, but I’m shocked that you would publically bash someone’s character when all you base it off of is hear say. Not everything is as it seems. And to say he didn’t love her…. How awful and cruel. How on earth would you know? Everyone acts like Anna was some pawn to be controlled. The only one that was controlling anything was Anna and she had Howard wrapped around her finger. He was the only person Anna had in her corner and thank god he was there to fight to have her buried by her beloved son and not in Texas with her sleazy money grubbing family that she hated. How would you feel if someone were posting about you saying you were guilty of something you didn’t do or that you didn’t love the most important person in your life? I bet you wouldn’t like it much.

  14. Megan says:

@R- your bashing them for saying things are true when they have no idea which is exactly what your doing. so i don’t get your point other than YOU THINK he loved her and helped her.

  15. R says:

Yes, but saying someone loved someone isn’t bashing them. Saying someone is guilty of murder when you have no clue is.

  16. noodlemonkey says:

Ya know, Anna Nicole was actually never included in J. Howard’s will. That was the issue with the litigation. She claimed he told her, and no one else, that he would giver her money when he passed away, but he never told anyone else of this intention or put it in his written will. I’m not buying it. She was a gold-digger–nothing more and nothing less.
