Still faces suspension of his driver's license
Shia LaBeouf NOT Charged With DUI

Good news for Shia LaBeoufhe won’t be charged with driving under the influence of alcohol as a result of the car accident he was involved in back in July. Bad news for Shia LaBeouf … because he refused to take a Breathalyzer test at the scene of the accident, the LA County Sheriff’s Department is recommending that his driver’s license be suspected for up to 6 months as a result (driver’s license suspension is mandatory for everyone who refuses to submit to a field sobriety test):

Shia LaBeouf won’t face DUI charges for the July 27 car accident that crushed his hand, the L.A. County District Attorney’s Office announced Thursday. “After reviewing the case, we’ve declined to file any charges due to insufficient evidence,” says DA spokeswoman Jane Robison. Following the crash, the 22-year-old Transformers star was cited with misdemeanor DUI while he was still at the hospital. Prosecutors instead plan to file criminal charges against the other driver, who was found to have run a red light, Robison says … Although the DA rejected the case, LaBeouf still faces a DMV hearing Friday and the possible suspension of his driver’s license, L.A. County Sheriff’s spokesman Steve Whitmore tells PEOPLE. “When an individual refuses to take a blood alcohol test, that person’s license is automatically suspended for six to nine months,” says Whitmore.

In the end, it’s a good day for Shia … having a suspended license is the least of his worries. I understand the lad still has more hand surgery in his future to repair the damage done to his hand by the accident. Reports are that he will eventually be fully recovered from his injuries but surgery isn’t fun for anyone. Even tho Shia wasn’t deemed to be at fault for this accident, I hope the kid can keep his nose out of trubs — no more run-ins wit the law, ya hear? Perhaps this time he has finally learned his lesson … I guess time will tell.

Alan Panettiere Charged With Battery

Ruh-roh … not so happy news for the Panettiere family. It turns out that prosecutors have decided to charge Alan Panettiere, father of Heroes star Hayden Panettiere, with misdemeanor battery after he was arrested for allegedly assaulting his wife Lesley Vogel in their West Hollywood, CA home on August 11. According to police, Mr. Panettiere was taken into custody after he allegedly struck his wife “one or two times” in the face with a closed fist and will now face charges as a result:

Hayden Panettiere’s father, Alan, has been formally charged with misdemeanor battery after he allegedly assaulted his wife last month, the L.A. County District Attorney’s Office announced Thursday. Panettiere, 49, faces arraignment on Oct. 11. If convicted, he faces up to a year in county jail. Alan Panettiere was arrested Aug. 11 at the family’s West Hollywood home after he “struck his wife (Lesley Vogel) one or two times on the cheek causing bruising with a closed fist,” a sheriff’s spokesman said … Another sheriff’s official confirmed that alcohol was involved. Shortly after he was released on bail, Alan Panettiere told Extra the incident was a “misunderstanding” and that “nothing actually happened.” And daughter Hayden, 19, downplayed the incident, saying, “It was blown way out of proportion by a sheriff who wanted his 15 minutes of fame.”

I have to say, I really love Hayden but I am really concerned at how this incident has been downplayed almost as soon as it happened. The very day after Alan Panettiere was released on bail back in August, he and wife Lesley were photographed walking their dogs together in their neighborhood as if nothing were wrong at all. I find it hard to believe that the LA Country prosecutors are just looking to prosecute just for “15 minutes of fame”. Domestic assault should never be tolerated, should never be swept under the rug. Obvs, the county prosecutors think this case is worth prosecuting. In the end, I hope that justice can be served — if no assault took place, then the truth should win out. If, tho, an assault did take place against Lesley Vogel, I sincerely hope that the proper punishment is handed out. This is just a very sad situation all the way around.

’9 To 5: The Musical’ Opens In LA

9 to 5: The Musical had its official opening night at the Ahmanson Theatre in LA last weekend to begin its short run in SoCal before the show makes the move to Broadway early next year — and Broadway World was there to capture all the fun. Here are a few amazing photos from the show’s opening night, beginning with the cast bows at the end of the opening night performance:

9 to 5: The Musical opened on September 20th 2008 at the Center Theatre Group/Ahmanson Theatre. Performances will continue through October 19, 2008. 9 To 5: The Musical, based on the 20th Century Fox motion picture, will begin previews on Broadway Tuesday, March 24, 2009, and will open Thursday, April 23, 2009, at the Marriott Marquis Theatre (1535 Broadway). 9 To 5: The Musical marks the Broadway debut of seven-time Grammy Award winning singer, songwriter and musician Dolly Parton as composer and lyricist. The musical’s book by Patricia Resnick is based on her original story and screenplay for the smash 1980 film comedy. Directed by two-time Tony Award winner Joe Mantello and choreographed by Tony Award winner Andy Blankenbuehler, 9 To 5: The Musical will star four-time Emmy Award winner and Tony Award nominee Allison Janney, Stephanie J. Block, Megan Hilty, and two-time Tony Award nominee Marc Kudisch. 9 To 5: The Musical will have its world premiere engagement in Los Angeles at the Center Theatre Group/Ahmanson Theatre beginning previews Wednesday, September 3, opening Saturday, September 20, and playing through Sunday, October 19, 2008.

I gotta say — Lily Tomlin, Jane Fonda and Dolly Parton were lookin’ pretty fierce. Dabney Coleman, bless his heart, has seen better days. ‘Equus’ Opens On Broadway

After 20 days in previews at the Broadhurst Theatre here in NYC, the US revival of Equus (which stars Daniel Radcliffe, Richard Griffiths, Kate Mulgrew and others) had its official opening night performance last night. Here are a couple pictures of Daniel Radcliffe (who plays Alan Strang) and Richard Griffiths (who plays Dr. Martin Dysart) taking their final bows after last night’s premiere performance:

Harry Potter star Daniel Radcliffe has received rave reviews for his performance in Equus once again as the play opened on Broadway. The 19-year-old returned to his role as disturbed stable boy Alan Strang in New York in front of a star-studded audience which included Glenn Close and Haley Joel Osment. “The young wizard has chosen wisely,” said Ben Brantley in the New York Times, adding that Radcliffe “steps into a mothball-preserved, off-the-rack part and wears it like a tailor’s delight – that is, a natural fit that allows room to stretch”. “His acting, beautifully understated and withdrawn, has just the right manner for this horribly mixed-up adolescent,” said the New York Post. Radcliffe’s performance – which requires him to strip down – was also well-received during the London production of Peter Shaffer’s play. He stars opposite actor Richard Griffiths, who returns as the character’s psychiatrist, in the production at Broadway’s Broadhurst Theatre. The play centres on a teenage boy who blinds six horses and how a psychiatrist explores why.

As you may recall, I was lucky enough to see this show a couple of weeks ago and I just loved it … so I shant go into raves again in this post. Here are a few pics of Dan pressing the flesh with his hordes of admirers who waited for him to make his exit from the theater after his performance:

I’m not sure how I feel about Daniel‘s blue suit but it was his night and I think it’s cool for him to wear whatever he likes … the boy is fully nekkid on stage, for Pete’s sake. I’m not too impressed that Haley Joel Osment came out for the event but it is very nice to see Project Runway Season 1 alum Austin Scarlett out and about. Equus is scheduled to run on Broadway until February, I urge those of you who are able to make it out to the Broadhurst to see this show. It’s a very good show, well acted and, you know, there’s the nekkidness. What more could you want from a Broadway play?

The track is hot, yo. It sounds infinitely better than the crappy leaked snippet that we got to hear last weekend. I know some folks were worried that the song might not be great after reading the lyrics but, trust me, they work in the actual song. It’s a great up-tempo song … it’s bound to be a megahit. I’ve already listened to it about 5 times, you have to hear it for yourselves. I absolutely love it, so worth the extra few days wait … I gotta know, do you love it?
